1. Acceptance of Terms

By accessing or using our AI training platform ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

The Service provides an advanced AI training platform designed to assist healthcare professionals in honing their patient communication skills. The platform includes tools that simulate patient interactions, allowing users to practice various clinical scenarios and receive detailed feedback on their performance.

3. User Accounts and Responsibilities

  • You are responsible for maintaining the confidentiality of your account and password.
  • You agree to notify us immediately of any unauthorized use of your account.
  • You must not use the Service for any illegal or unauthorized purpose.
  • You agree to comply with all local laws and regulations regarding your use of the Service.

4. Privacy and Data Usage

Our collection and use of personal information in connection with the Service is as described in our Privacy Policy.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by OslerAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. User Content and Recordings

While the Service is based on pre-programmed scenarios, any feedback or data you provide remains your responsibility. You agree not to input any real patient Personal Health Information (PHI) into the system. The platform is a training tool and is not designed to handle or store real PHI.

6.1 Your Content and Our Licence

You retain any rights you have in content you provide through the Service, including your voice and audio recordings ("User Content"). By using the Service, you grant OslerAI a non-exclusive, worldwide, royalty-free, transferable, and sublicensable licence to host, store, record, transcribe, reproduce, modify, analyze, and otherwise process User Content as reasonably necessary to:

  • Provide, operate, secure, support, and troubleshoot the Service.
  • Generate evaluations, feedback, transcripts, and other features you request.
  • Conduct quality assurance, research, and product development.
  • Train, test, evaluate, and improve AI models, algorithms, and related technologies.
  • Create aggregated or anonymized information as described in our Privacy Policy.

OslerAI does not sell personal information or identifiable audio recordings. We may use, disclose, license, or sell information created from User Content only after it has been irreversibly anonymized so that there is no reasonable possibility of identifying you directly or indirectly. We will not use your identifiable voice or User Content in advertising or promotional materials without separate permission.

The licence above continues only for as long as reasonably necessary for the permitted purposes and our applicable retention requirements. Rights relating to information that has already been irreversibly anonymized survive account deletion and termination because that information can no longer be associated with you.

7. Technical Requirements and System Limitations

To use the Service effectively, you acknowledge and agree that:

  • Internet Connection: A stable, high-speed internet connection is required for optimal performance. OslerAI is not responsible for service interruptions, poor audio quality, or system failures resulting from inadequate internet connectivity.
  • Device Compatibility: You are responsible for ensuring your device meets the minimum technical requirements for the Service.
  • Service Availability: While we strive for continuous availability, the Service may be subject to maintenance, updates, or unexpected downtime.
  • Performance Variations: Service performance may vary based on your technical setup, internet connection quality, and device specifications.

8. Subscriptions and Payments

Certain features of the Service may be subject to payments now or in the future. You agree to pay all applicable fees for subscriptions or credits as described on the platform. All payments are handled by third-party payment processors, including Stripe for card payments and, where offered, Flutterwave for Mobile Money. You also agree to the applicable processor terms.

One-time call packs add the number of practice-call credits shown at checkout. One credit is consumed when an AI patient simulation is successfully started and a call identifier is issued. Purchased call-pack credits do not expire, accumulate with other available practice credits, are personal and non-transferable, and are not a subscription. Prices identified as tax-inclusive are the total advertised price; any required tax components may be itemized in the transaction record without increasing that total.

Refunds: For a subscription, we will refund the current billing period and cancel the subscription when a request is made within five (5) days after payment and no additional calls have been made during that billing period. For a one-time call pack, we will issue a full refund when a request is made within five (5) days after payment and none of the calls included in that pack have been used. Partial refunds do not automatically restore or remove call credits and may require manual reconciliation. These rules do not limit rights that cannot be excluded under applicable law.

8.1 Unlimited Access and Fair Use

Plans described as offering "unlimited" practice access do not have a fixed number of practice sessions for ordinary, individual study during the stated access period. "Unlimited" does not mean unrestricted or unmetered use and remains subject to this fair use provision.

Access is personal and non-transferable. Unless OslerAI expressly authorizes it in writing, you must not share account credentials, permit concurrent use by multiple people, resell or commercially exploit access, use bots or automated systems, circumvent technical controls, or operate the Service continuously or at volumes inconsistent with genuine individual exam preparation.

We may monitor usage volumes, frequency, duration, concurrency, technical patterns, and related service costs to protect the security, availability, quality, and financial sustainability of the Service. We do not publish fixed fair-use thresholds because usage patterns, technology, and service costs change over time.

In our discretion, we may immediately slow, limit, pause, suspend, or terminate access, with or without prior notice, if we reasonably believe that use is unusually intensive, automated, shared, resold, abusive, disproportionately costly, harmful to service capacity or other users, an attempt to circumvent controls, or otherwise inconsistent with ordinary individual preparation or these Terms.

Nothing in these Terms limits any non-waivable rights or remedies you may have under applicable consumer protection law.

9. Termination

We may terminate or suspend access to the Service immediately, without prior notice or liability, where permitted by law, including if you breach these Terms, create a security or operational risk, or engage in use described in Section 8.1.

10. Limitation of Liability

In no event shall OslerAI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Educational Disclaimer and Evaluation Limitations

Educational Purpose Only: The Service is provided strictly for training and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Reliance on any information provided by the Service is solely at your own risk.

11.1 Evaluation and Assessment Disclaimers

You acknowledge and agree that:

  • No Guarantee of Accuracy: AI-generated evaluations, scores, and feedback may not be accurate, complete, or reflect actual performance standards.
  • Not Reflective of Standardized Exams: Evaluations provided by the Service may not accurately reflect the grading criteria, standards, or expectations of official standardized medical examinations, licensing exams, or certification assessments.
  • Training Tool Only: The Service is a supplementary training tool and should not be relied upon as the sole method of exam preparation or performance assessment.
  • No Exam Guarantee: Use of the Service does not guarantee success on any medical examination, certification test, or professional assessment.
  • Subjective Feedback: AI-generated feedback is based on programmed algorithms and may not capture the nuances of human clinical judgment or standardized scoring methodologies.
  • Continuous Improvement: The AI system is continuously being improved, and evaluation criteria may change without notice, potentially affecting consistency of assessments over time.

12. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
